An attorney for Linda claimed at the time that his client only had a glass of champagne at an event on an empty stomach but antibiotics that she took prior to attending the event shot up the alcohol effect and registered a .084 in blood alcohol level when she was stopped by the cops, which is over the legal limit in the state.

The Los Angeles County District Attorney has charged Linda with two misdemeanor counts of DUI and also one count of driving on a suspended license.

The case will be heard in front of a judge later this month and if convicted she can face up to 18 months in jail although it’s very highly unlikely she will spend a second behind bars.

The 53 year old was in hospital for a coli infection and was on antibiotics, which might have helped spike up the alcohol blood level according to her lawyer.

“She regrets it. She’s a mom, so she’s embarrassed about it,” her lawyer Raymond Rafool told The News. “She’s just thankful it wasn’t worse and thankful nobody got hurt. The police were all very nice. It wasn’t a scene at all. It was anticlimactic.”

According to TMZ.COM, Linda was booked at around 1:30AM yesterday morning after cops found her blood alcohol level topping .084, just above the California legal limit of .08.

Linda was originally stopped for speeding after she was on her way home from a jewelry event in Los Angeles. A rep for Linda said she drank a glass of champagne on an empty stomach and the combination of alcohol and antibiotics increased the effects.

She was released from jail a few hours later after posting a $5,000 bail.
